For India, the wait times for EB-2 and EB-3 (Final Action – April 2012) show no signs of abating. The short respite when EB-3 priority date galloped ahead and was at January 2015 (Filing Action) on the Visa Bulletin for October 2020 is now a distant memory. So much so that the American Immigration Lawyers Association hosted a business seminar on the subject earlier this year with “post mortem” in its title. The frenzy surrounding the filing of thousands of petitions has finally died down (pun unintended). The last time we saw this kind of mass excitement around an immigration event was in July 2007 when the priority dates became current for all employment-based categories. However, just as this summer has given way to the hurricane season in the South, uncertainty and tumult surrounds the immigration landscape.
